PVT William Simeon Duke1,2,3

M, ID# 11393, (1791 - 1860)
Father:LT Robert Duke of Richland SC & Marion MS (a 1751 - a 1820)
PVT William Simeon Duke was born in 1791 at South Carolina. He was the son of LT Robert Duke of Richland SC & Marion MS. PVT William Simeon Duke married Mary R. Peacock c 1825. PVT William Simeon Duke died in 1860 at Jasper Co, Mississippi.
At least four white men named Simeon Duke and born about 1791, 1800, 1830, and before 1891 lived in Mississippi and Lousiana. Their records were parsed using census data. None used a middle name or initial in the records. For differentiating in this biography, the eldest two men were referred to as "senior" and "junior" -- as they were so noted in the county where they lived simultaneously in 1830 -- although they were not father and son because they were only about 10 years apart in age. Simeon Duke senior of Richland Co, SC was born about 1791 in South Carolina, married Mary and resided in Mississippi according to the 1850 and subsequent censuses. Simeon Duke junior was born about 1800 in Georgia, married Elizabeth, and moved from Mississippi to Louisiana according to the 1850 and subsequent censuses. Duke family genealogist Lynn Teague came to this same conclusion about the two men in 2005 (http://www.genealogy.com/forum/surnames/topics/duke/5675). Between 1821 when the younger Simeon reached the age of majority and 1837 when he moved from Marion Co, MS to Louisiana, records noted below for the elder Simeon could have been those of the younger Simeon, but given the increasingly responsible positions the elder Simeon attained, the records below are believed to be his.

Simeon Duke was the son of Robert. Orphan court documents recorded 14 Apr 1814 in Marion Co, MS state "Robert Duke for love and affection gives his son Simeon Duke one sorrel [chestnut] mare, 2 cows, etc." According to genealogist Lynn Teague, "Of the known people named Robert Duke in SC there is only one solid candidate for Simeon’s father, and that is Robert Duke junior, of Richland Co, Camden District, SC," a Revolutionary War veteran. Several of the Robert Dukes located in SC were too old or too dead by 1814, including Robert Duke of Lancaster Co and Robert Duke of Fairfield Co. Robert Duke of Lexington Co was too young to be Simeon's father.

According to his 2nd great-grandson Charles Edward Duke, Simeon was named William Simeon Duke, although that name was not found in any records. Charles' family tradition was Simeon was born in 1790 in South Carolina, and his brother Jeptha was thought to be born in 1794. Charles believes Robert Duke of Richland Co, SC was their father. The sons and their father came from the upper part of Richland Co, SC to Columbia, Marion Co, MS. A James Duke was also in the Columbia, MS area, but the relationship if any to Simeon was unknown. This family tradition was proven by a yDNA Y-111 test results comparison.

Nothing indicated the Simeon born 1791 had a surviving namesake son. Simeon Duke, the census taker in 1830, labeled himself and the other Simeon as senior and junior. However, the elder Simeon was never referred to in records as "senior" again, indicating he had no namesake surviving son. The younger Simeon left Mississippi about 1837 and apparently was not closely related.

After his arrival in Mississippi, Simeon, the senior, was noted continuously to be in or own land in southern Mississippi: 1813 - 1830 Marion Co; 1839 - 1840 Simpson Co; 1840 Clarke Co; 1845 - 1860 Jasper Co, where he apparently died before 1860 but his family continued to reside after his death.

By 1813 a Simon Dukes (sic) was residing in Marion Co, MS. This was believed to be Simeon senior because to be included as a head of household in the census the man would need to be age 21, thus born in 1792 or earlier. This same year a Jesse Duke was on the Marion and Lawrence Co, MS tax list; Jesse owned 252 acres on the Pearl River and one researcher believed Jesse was Simeon's father.

On 10 Aug 1819 Simeon Duke and Jeptha Duke of Marion Co, MS at the Washington land office purchased a quarter acre lot west of the Pearl River in Marion Co as tenants in common. Simeon and Jeptha are believed to be sons of Robert Duke of Marion Co, MS. Jeptha purchased 172 acres later that year on 13 Dec 1819 in Marion Co.

Simeon Duke served as the bondsman for the marriage of Robert Stacy and Martha Phillips on 7 Mar 1819 and for the marriage of Ansel Powell and Clarissa Moore on 27 Aug 1821 in Marion Co, MS. (Marion County Marriages, Mississippi Genealogy Trails, http://genealogytrails.com/miss/marion/marriages_1812-1824.html; Marie Luter Upton, Marriage Records of Marion Co, MS 1812-1860, 1958)

Columbia, the county seat of Marion Co, MS was named after Columbia, SC because settlers from the latter place settled the area of Columbia, MS. On 10 Feb 1820 Simeon Duke was appointed as one of the trustees for the newly established Columbia Academy. This was assumed to be the elder Simeon because a position of this stature is consistent with the positions Jeptha and Simeon were noted holding soon after in the county. (Revised Code of the Laws of Mississippi: In Which are Comprised all such Acts of the General Assembly, of a Public Nature, as were in Force at the end of the year 1823, George Poindexter, 1824)

The Marion County court ordered that Benjamin Ailey Geese, David Sumrell, Simeon Duke, James Summons, Allin Jenkins, Daniel Blue, Rees Perkins and Stephen Peek be appointed Jurors to view and lay out a road commencing at or near Thos. Mays plantation leading by Allin Jenkins Mill Tent and to intersect the River Road Southern Boundary line township the nearest and best way. (The Road Books, E. Russ Williams, records dated between 1812 and 1823; http://preserveriverroad.com/Perserve_River_Road/History_files/Road%20Books%20of%20Marion%20County%20Mississippi.pdf)

Simeon attained important and continuous roles in Marion County government and was clearly trusted and possessed standing in the community as a ranger, tax assessor and collector and sheriff. On 25 Apr 1820 Simeon Duke, Frances B. Lenoir and John Lott senior were bonded for $6000 whereupon Simeon Duke was appointed tax assessor and collector. The following year Simeon Duke, Lewis Hegewood and James Phillips junior were indebted to George Poindexter, Governor of Mississippi, in the amount of $6000 on 24 Apr 1821 when Simeon Duke was appointed tax assessor and collector. On 10 Jul 1821 James Phillips and S. Duke were witnesses when John Lott senior sold Joseph Pierce for $500 a certain lot on the east side of the Pearl River, north of the town boundary of Columbia, whereon the house of Pierce stood. (Various Deeds of Marion Co, MS; D. Allen, http://dallen1989.tripod.com/Deeds-MarionCo.html)

Simeon Duke, Charles Stovall and Gilbert Stovall were bound to Walter Leake, Governor of Mississippi, for $6,000 on 14 May 1822 when Simone was commissioned to serve as assessor and collector of taxes for Marion County. Jeptha Duke, Simeon Duke and Elijah Milbourne were bound to James Phillips for $5,000 on 9 Dec 1822 when Jeptha was appointed Marion County Treasurer. Simeon Duke, William Mellon and James McGowen were bound to Walter Leake under a $2,000 bond on 19 Feb 1823 when William Mellon was appointed Notary Public. Simeon Duke, William Mellon and Hugh McGowen were bound unto Walter Leake, Esq. Governor of Mississippi for $4,000 when Simeon Duke was appointed assessor and collector of taxes during the March court term, 1823. (Various Deeds of Marion Co, MS; D. Allen, http://dallen1989.tripod.com/Deeds-MarionCo.html)

Simeon Duke was elected sheriff on 4 Aug 1823 and charged to collect all fines and monies and perform all duties; as a result Simeon Duke, Thomas C. Patterson and Charles Stovall were bound under a $6000 bond dated 12 Aug 1823. On 23 Sep 1823 S. Duke and B. Norris were witnesses when John Lott senior for love and affection for his daughter Fanny, the wife and consort of John Alexander, gave and bequeathed her a tract of land. Simeon Duke, John Lott senior and Charles Stovall were bound to Walter Leake for $4,000 on 23 Mar 1824 when Simeon Duke was charged to assess and collect taxes; Simeon Duke was sworn into office by Gilbert Stovall 23 Mar 1824. Simeon Duke, Charles Stovall and Samuel Harper were bound to Walter Leake for $4,000 on 9 Mar 1825 when Simeon Duke was reappointed and commissioned as assessor and collector of taxes for Marion County; the bond was filed 29 Mar 1825 and recorded 4 Jun 1825 by Gilbert Stovall. Securities were approved for the foregoing bond before James Phillips and Simeon Duke was sworn into office. (Various Deeds of Marion Co, MS; D. Allen, http://dallen1989.tripod.com/Deeds-MarionCo.html)

Simeon likely married about 1825 because by 1830 Simeon Duke had three children and because the 1840 census includes a presumed daughter born 1825 - 1829. Whether this marriage was to Mary -- the wife on the 1850 census -- or an earlier wife is not known.

Simeon Duke swore on 6 Apr 1825 to take the census of Marion County according to law, which was recorded 25 Sep 1825. S. Duke and Hector McNeese witnessed a $1,000 bill of sale from Ebenezer Ford to Elias Ford for five negroes for life on 15 Dec 1824 or 1825; this witness may also be Simeon Duke. Simeon Duke, Thomas Reily and Charles Stovall were bound to David Holmes for $4,000 on 5 Apr 1826 when Simeon Duke was appointed as assessor and collector of taxes, as recorded 16 Apr 1826. W. S. Duke (unsure who this is) and A. J. Bracey witnessed settlement of a complex court case by auction og goods, chattels, lands and tenements of Charles Stovall, et al on 13 Aug 1825. Simeon Duke, Thomas C. Patterson and Alfred G. Moore were bound to Gerard G. Brandon, Governor of Mississippi, for $4000 in bond on 27 Mar 1827 when Simeon was to assess taxes. Again on 11 Apr 1828 Simeon Duke, Silas Drake and Sterling Powell were bound to Gerard Brandon for $4,000 when Simeon was commissioned Assessor. William Roach, Simeon Duke and Quinea Lewis were bound to Gerard Brandon for $2,000 on 2 Jun 1828 when Roach was made County surveyor. That same day on 2 Jun 1828 Simeon Duke, Thomas C. Patterson, James Owens, Johnson Silverberg, Ansel Powell and William McGowen were bound to Brandon for $4,000 when Patterson was commissioned collector of taxes. (Various Deeds of Marion Co, MS; D. Allen, http://dallen1989.tripod.com/Deeds-MarionCo.html)

On 5 Sep 1826 Simeon Duke served as the representative for Nancy Pullens to give consent for her daughter Martha Parten/Pullen to marry Levi Bass. Isaac Brakefield served as the magistrate. (Marie Luter Upton, Marriage Records of Marion Co, MS 1812-1860, 1958)

The next year Simeon became the tax assessor again when Simeon Duke, Edward Englehard and Thomas C. Patterson were bound to Governor Brandon for $4,000 on 3 Mar 1829. Simeon Duke, most likely his brother Daniel Duke, and Thomas C. Patterson were bound to Governor Brandon for $4000 on 1 Mar 1830 when Simeon Duke was appointed assessor of taxes and took the oath. On 29 Jan 1830 Simeon Duke and Mary Duke his wife deeded to Daniel Duke, most likely Simeon's brother, for $400 the northeast quarter, section 12, T 2, R 13 E. Witnesses were William L. Ragan, William Bush and Isham Pittman. (Various Deeds of Marion Co, MS; D. Allen, http://dallen1989.tripod.com/Deeds-MarionCo.html)

According to "Mississippi: Comprising Sketches of Towns, Events, Institutions" edited by Dunbar Rowland and published in 1907 (https://archive.org/details/mississippicomp01rowlgoog), Justices of the Quorum for Marion Co between 1818 and 1827 included Simeon Duke and Jepthah Duke.

In early 1830 the Committee of Claims was instructed to inquire into the expediency of allowing Simeon Duke, Sheriff of Marion Co, fifty dollars for services rendered the State in guarding certain prisoners on behalf of the State in the year 1820. ("Journal of the House of Representatives of the State of Mississippi," volume 14-15, General Assembly, House of Representatives, G. R. and J. S. Fall, printers, Jackson, MS)

The Sep 1830 Marion Co, MS federal census is titled "Schedule of the Whole Number of Persons Within the Division Allotted to _Simeon Duke_ by the Marshall of the __ District (or Territory) of ___." In 1830 Simeon included both himself as Simeon Duke "senior" and Simeon Duke "junior" on the Marion Co, MS census but the two men were not living in close proximity. This was the only year the contemporaries were noted in the same location.

Simeon senior was enumerated as "Simeon Dukes senior," age 30-39, when he was residing in Marion Co, MS in 1830 with a female presumed to be his wife Mary, age 20-29, and 2 females and 1 male under age 5. This man was believed to be the Simeon born 1791 because the younger Simeon was not married until 1826 and thus it would have been more difficult, but not impossible, to have 3 children by 1830. Importantly, there were also four slaves in the household -- a female slave age 24-35 apparently with her three slave children -- one female age 10-23 and a male and female under age 10. Slave records associated with Simeon continue later in this geographical area.

In 1830 Simeon senior was living two doors from Daniel Duke, who is presumed to be his brother. Daniel cannot be Simeon's son Daniel who was born circa 1838, although he could be an older son Daniel born about 1810 or another relative.

Also noted on the same county census was a "Simeon Dukes junior," age 30-39, with a female presumed to be his wife Elizabeth age 20-29 and a son and daughter under age 5. Later censuses show this Simeon was born about 1800 and moved to Catahoula Co, LA by 1837.

After 1830 Simeon senior, born about 1791, moved to and stayed in the contiguous Mississippi counties of Clarke - Smith - Jasper with his wife Mary and their family, and Simeon junior, born about 1800, moved to and stayed in Lousiana with his wife Elizabeth and their family. As yet, there is no known relationship between these two men who differ in age by nine years.

On 28 May 1839 Simeon Duke of Simpson Co, MS -- two counties north of where Simeon senior had been living in Marion Co -- acquired a land patent through the Mount Salus land office for 80 acres in Washington Co, MS, which is located on the west central state border. This acquisition was followed shortly after on 10 Feb 1840 by another 80 acre land patent at the same land office by Simeon Duke of Simpson Co, MS. These two acquisitions were believed to be those of Simeon Duke senior because he was the only Simeon known to be living in the state at this time who was of legal age to purchase land.

Next the undated 1840 census listed Simeon Duke age 40-49 living in Clarke Co, MS; this is Simeon senior because the ages of the family members exactly fit with the ages of him named family members in the 1850 census. Simeon was enumerated in 1840 with his wife age 30-39, 2 males under age 5, 1 male age 5 - 9, 1 male and 1 female age 10-14, and 1 female age 15-19. There were seven slaves in the household: 1 female age 36-54, a female 24-35, a female and a male under 10, and a male age 10-23. Some of these slaves or their descendants may be the black Duke families found in the 1870 census in northern MS.

Simeon Duke was on the 1841 and 1845 Clarke Co, MS censuses. In 1845 in nearby Smith Co, MS a Simon Dukes [sic] was enumerated. Although already enumerated in 1845 in Clarke Co, this man was quite possibly Simeon senior because he was recorded living in adjacent Jasper Co by 1850 and may have owned land in these two adjacent counties or have been in the process of moving during the census. Although unlikely, this Smith Co man could have been a namesake son who had turned age 21, thus born about 1824; if so it is unknown where he went after 1845 because no further records were found in that county and no records referred to a senior - junior relationship. This Smith Co Simeon was definitely not a son of Simeon Duke junior who left Mississippi before 1837 with his young children when he bought land in Louisiana.

In 1850 Simeon Dukes [sic] age 60 and his wife Mary R., age 40 and born in Tennessee, were living in Bay Spring, Jasper Co, MS with six children including Daniel born circa 1838. Living two doors away was his daughter Eliza age 18 with her husband William Yelverton age 28 and their children Simeon age 1 and Larinda Sue age 3, who later married her aunt Victoria's husband Joseph Thompson. Living next door was Nancy Caroline age 22, perhaps another daughter of Simeon's, with her husband Benjamin Thompson, age 24 and born in South Carolina, and two children with different surnames. Simeon's daughter Victoria married into the Thompson family of SC.

Simeon Dukes (sic) was noted on the Jasper Co, MS slave schedule in 1850, which was the last time the family was noted with slaves.

Within the last six years of his life at almost age 70, Simeon Duke living in Jasper Co acquired five patents with eight parcels of land totaling 318 acres and another patent for 160 acres, the latter which he immediately sold. Simeon might have planned to leave land to his 5 sons and his sons-in-law. Most patents were for Jasper Co land with one patent for land in the adjacent Smith Co. These patents were likely for Simeon senior because he was residing in Jasper Co. On 15 Mar 1854 at the Augusta land office Simeon Duke of Jasper Co purchased three patents for land in Jasper and Smith Co, MS. He patented 80 acres composed of 2 parcels in Jasper Co, MS. That day at Augusta he also purchased 40 acres in Jasper Co and 37 acres in adjacent Smith Co, MS.

On 2 May 1859 Simeon Duke of Jasper Co purchased 40 acres in Jasper Co through the Augusta land office. That same year on 10 Nov 1859 Burben W. Yelverton of Jasper Co purchased 2 parcels totaling 80 acres in Jasper Co at the August land office; the Yelverton family married into the family of Simeon Duke senior, although it unknown how this particular Yelverton fits into the family.

On 10 Apr 1860 Simeon Duke of Jasper Co purchased 3 parcels of Jasper Co land totaling 121 acres through the Paulding, MS land office.

Records indicated War of 1812 military service for one or more men named Simeon Duke in Mississippi who served as a private in the 2nd Regiment (Jenkins'), Georgia Volunteers and Militia and as a private in Spencer's Company, Mississippi Militia. It is unknown if this military service was performed by two different men in the two states or by the same man sequentually; if the service was by different men, more analysis of the Simeon Duke records will be needed to accommodate a third contemporary Simeon Duke. Simeon Duke junior born about 1800 who moved to Louisiana served in a different Georgia unit.

On 10 May 1860 under the Warrant Act of 1855 to grant bounty land for military service, Simeon Duke received 3 parcels of land in Jasper Co, MS totaling 160 acres for service as a private in Captain Spencer's Company, Mississippi milita during the War of 1812 through the Augusta land office. He assigned the acreage to William McNeal. After this point, no other records were found for this Simeon.

On the census enumerated 17 Sep 1860 Simeon's wife Mary was shown living alone with their children and M. L. Roach a 34-year-old domestic servant in Jasper Co. Mary had $4,240 in real estate and $12,000 in personal property. Of note, Mary was not the Mary Duke, a widow age 68, living with her son Benjamin F. Duke, transcribed as Bery F. Duke but written as Benj F. Duke age 39, in Bell Co, TX, with his family; this Benjamin was born in Tennessee to Robert and Mary Duke -- not Simeon and Mary Duke -- and lived in Sylamore, Izard Co, AR in 1860 - 1870 before moving to Texas.

By 1866 Mary was enumerated as Mrs. M. R. Duke, age 60-69 living in Jasper Co, MS with a male age 30-39 (likely her son William) and 1 female under 10 (possibly a granddaughter) and one female age 10-19 (likely her daughter Victoria.) Nine doors away is her widowed daughter Eliza Yelverton with her family and 2 doors away is her widowed daughter-in-law Mrs. C. C. Duke with her family. Two other widows -- Matilda Blackwell and Nancy Rogers -- are living nearby and may possibly be part of Mary's extended family as well. In addition to seven known children of Simeon and Mary, there could also have been up to four additional children.

Larro Grants of Jasper Co, MS included in Township 2, Range 10, section 8, Andrew J. Brown, James Summers, and 3 for Simeon Duke: section 9 Simeon Duke in 1854; Section 1?: Simeon Duke in 1854; and Section 26: Simon Duke in 1855. Dempsey Brown owned land close to some of Simeon's grants; Dempsey's family was also intermarried with Simeon's. Other Simeon Dukes lived at this time in Mississippi. A younger Simeon Duke, son of Reason Duke, resided in the east central part of the state in Monroe Co, MS. In 1850 Simeon Duke, age 20 and born circa 1830 in Alabama, was living in Western Division, Monroe Co, MS with his family: Reason Duke age 50 born about 1800 and his wife Rebecca age 45 both born in Georgia, and children James H. 23, John D. 21, Simeon 20, Thomas F 18, William 15, Peyton R. 13, Elon 12 and Reason 10 all born in Alabama except Peyton who was born in Mississippi. A family tradition among some Duke descendants was they were related to Reason Duke. Of note residing two doors away in 1850 was Sherod Kenton age 48 born in Georgia, a farmer with $4000 in real estate. In the 1860 Western Division, Monroe Co, MS census, Simeon Duke age 35 and born in Alabama, was listed as an overseer in the household of Sharod Kenton. Despite the five-year discrepancy in age, this was most most likely the son of Reason Duke, enumerated in Monroe Co, MS in 1850 living next to Sherod Kenton.

A Simeon "Sim" Duke served in Company F, 43rd Regiment, Mississippi Infantry during the Civil War. He could have been the Simeon from Monroe Co who was the son of Reason.

By 1870 the Simmeon Duke (sic) of Monroe Co was enumerated alone as Simmeon Duke age 39 and born about 1831; he had $160 of personal estate. Living three doors away was most likely his brother William Duke, another son of Reason Duke, a 36-year-old farmer born in Alabama, with his wife Francis age 24 born in South Carolina, and their children Reason age 4 and Ida age 1 both born in Mississippi.

Finally after the Civil War two black Duke families were enumerated living in northern Mississippi. In Abbevile, Lafayette Co, MS in 1870 Tomas Duke, a 37-year-old farmer born in Alabama was living with his wife Charity and six children all born in Mississippi. Next door was Clancy Duke, a 30-year-old female farmer born in Mississippi with four children all born there, including a 13-year-old son Simeon Duke born about 1867. Perhaps these people were descendants of Simeon Duke's slaves.

Of note there are many Duke land patents in Mississippi counties and Dukes patent records in Smith, Simpson and especially Marion counties.

Mary R. Peacock1

F, ID# 11395, (c 1806 - )
Mary R. Peacock was born c 1806 at Tennessee. She married PVT William Simeon Duke, son of LT Robert Duke of Richland SC & Marion MS, c 1825.
The book "Four Centuries of the Pascagoula -- History and Genealogy of the Pascagoula River Country" by historian Cyril Edward Cain in 1953 noted "Simeon Duke of South Carolina came to Mississippi in his youth and married Mary Peacock." No list of their children is available but it is known that they had five sons. The names of only two are known: Dr. B. F. Duke was the fifth and the other known was Capt. D. L. Duke of the Mississippi Regiment, Confederate States Army." Of note, this book was published over a century after Simeon and Mary were married, so this does not prove Mary's surname was Peacock.

If Mary was born about 1806-1810 to a Peacock family in Tennessee, Micajah Peacock, age 16-25, living in Jefferson, Rutherford Co, TN had 7 members in 1810 including 3 females under age 10. In 1820 Micajah was enumerated as Micaph Pecock in Lebanon, Wilson Co, TN. In 1820 John Peacock. age 26-44, living in Franklin Co, TN had 10 family members including a female age 10 - 15. Another possible birth family for Mary could be the William Peacock senior family found in Simpson Co, MS in 1830 because Simeon and Mary likely met in Mississippi. In case Mary's family originally came from South Carolina, according to land records and censuses noted by genealogist Lynn Teague, the Abraham, Levi and Samuel Peacock families lived on Spur Branch at the South Edisto River in old Orangeburgh District -- Barnwell Co, not Fairfield Co, SC.

One researcher reported Mary was Mary Jane Bridges.

By 1830 Simeon Duke had three children, hence he would have married by about 1825 and a daughter noted later as minimum age 15 in 1840 supports that analysis. This is problematic given that his wife Mary's birth was reported as 1810 in the 1850 census, but she was later reported born in 1806 in the 1860 census, so likely Simeon did not have a wife before Mary.

William W. Duke was born c 1834 at Mississippi. He was the son of PVT William Simeon Duke and Mary R. Peacock. William W. Duke married Isabelle Carolina Cargile c 1857 at Mississippi. William W. Duke died in 1866.
William Duke, a saddler age 25, was enumerated on the 1860 Augusta, Southern District, Perry Co, MS census with his family. Perry Co is equidistant from both Marion and Jasper counties where his parents lived over a period of time.

On 15 Nov 1904, when William would have been about age 70, a William W. Duke received a patent for lots 6, 8 and 9 totaling 124 acres in Smith Co, MS under the Homestead Act of 1862. Smith Co is adjacent to Jasper Co where William's parents resided and where the man thought to be his brother John received land 6 years earlier.

CPT Daniel L. Duke1

M, ID# 11397, (c 1838 - )
Father:PVT William Simeon Duke (1791 - 1860)
Mother:Mary R. Peacock (c 1806 - )
CPT Daniel L. Duke was born c 1838 at Mississippi. He was the son of PVT William Simeon Duke and Mary R. Peacock.
Daniel L. Duke enlisted in 1861 as a first corporal in Company F, Mississippi 16th Infantry Regiment, Confederate Army. He mustered out with the rank of captain, indicating Daniel's family likely had social standing in the community.

Daniel clearly was enumerated as Daniel L. on the 1860 census and also on his military records. Nevertheless, considering that two men with his brothers' names received Smith Co, MS land under the Homestead Act of 1862, he may be the Daniel C. Dukes who received 40 acres in Smith Co, MS, the county his brothers received land, under the Homestead Act of 1862 on 5 May 1899.

On 27 Aug 1898 a John S. Dukes, who is likely this John Duke, received 75 acres under the Homestead Act of 1862 in Smith Co, MS. He is thought to be John Duke because Smith Co is adjacent to Jasper Co where his parents lived.

Christopher C. Duke is presumed to be the C. C. Duke who was a private in Company B, 1st Regiment, Mississippi Cavalry, Confederate Army. He apparently did not survive the war. The 1866 Jasper Co, MS census included a Mrs. C. C. Duke, age 20-29 with a son and 3 daughters under age 10.
