      Nicholas Spencer was apparently a descendant of the famous Spencers of Northamptonshire in England. He apparently arrived in Virginia as early as 1623. He acquired considerable lands in Westmoreland Co, VA between 1668 and 1680. He was noted in 1680 as the Secretary of the Virginia colony and was still serving as secretary in 1689 when he died.

Nicholas Spencer will was proven in England in 1700 in the Bedfordshire wills in the Prerogative Court of Canterbury; it is unclear whether this was the will of the father or of the son.
