SGT John Oliver Ashley I1

Father:Francis A. Ashley (a 1725 - 1790)
Mother:Rachel Touchstone (1724 - )
Charts:Juanita Bessie Counts * lineage
     SGT John Oliver Ashley I was born c 1755 at Mechlenburg, Bladen Co, North Carolina. He was the son of Francis A. Ashley and Rachel Touchstone. SGT John Oliver Ashley I married Mary "Polly" Calloway ? on 16 Dec 1781 at Mercer Co, Kentucky. SGT John Oliver Ashley I married Mary "Polly" Hardin ? on 17 Apr 1797 at Mercer Co, Kentucky. SGT John Oliver Ashley I died on 11 Apr 1828 at McMinnville, Warren Co, Tennessee.
      Solid conclusions about John Oliver Ashley are difficult to make because of the wealth of confusing data: there are innumerable descendants of John Ashley who are interested in genealogy and have posted predominantly duplicative data; there are many John Ashleys during the era; the names Ashley and Ashby are easily confused on singular documents and look very similar to this researcher on some original records; and there is much speculation but no clear documentation as to who John's two wives were. To wit, the name on John's military service records and his marriage record to Mary "Polly" Hardin may be "Ashby," and therefore he may never have served or married Mary "Polly" Hardin. Telling "le" from "b" often rests on the preponderance of evidence and the eye of the researcher. However, it is extremely difficult to discount John's possible marriage to Polly Hardin given that his grandson Uriah named one of his sons Hardin. Far more problematic is John's purported first marriage to Mary "Polly" Calloway from whom we descend and for whom there appears to be no substantial family bible record. The following expands on the research and the needs for further proof. A defense for the possibility of Hardin and Calloway being his wives is those two names were given to two of John's grandsons, but that could have happened for other reasons.

During the Revolutionary War, John Ashley was living in Mechlenburg, NC. He is reported to have been commissioned 4 May 1781 and served as a sergeant major in the 10th North Carolina Regiment, Continental Line under Col Abraham Shepherd. As of Apr 2015 the Daughters of the American Revolution stated the John in the 10th NC Regiment was a John Aspley, not Ashley; having looked at the original document the writing could certainly be Ashley because the third letter is a cross between an h and a p. However, a John Ashley had three military vouchers in the North Carolina State Archives, the last of which states John Ashley served as a soldier:
--No 366, General Assembly, May 1780 – John Ashley allowed 202 pounds and 2 shillings as per report of the committee of claims concurred with;
--No 383 Agreeable to Act of Assembly, passed Jan 1792, indebted to John Asheley of the late Continental Line 6 pounds, 13 shillings and 4 pence, being ... pay and interest, Aug 1783 (Hillsborough, 1 May 1792);
--No 255 By virtue of the authority vested in us by an Act of the General Assembly, passed at Newburn, Jan 1792, we hereby certify the State of North Carolina is indebted to John Ashley, late a soldier in the Continental Line of said State, the sum of 19 pounds, 17 shillings and 2 pence with interest from 1 Aug 1783. (Hillsborough, May 1792. Oage 1007m, Vol 16 of Colonial Records of North Carolina lists John Ashley, 10th Reg, Com. 5 May 1781.)
Because of the number of John Ashleys this family tradition may apply to some one else or even to his son. Family tradition is John suffered a gunshot wound in battle. His horse was also shot from under him in a battle in South Carolina, fell on him and broke his leg leaving John a cripple the rest of his life. He was reportedly granted 1000 acres at Midfork LicKing, Jefferson Co, KY, but bequests or sales of this land were not noted in the records.

Two marriage dates have been aligned with John -- 1781 and 1797 -- which respectively cover the births of his many children. A number of researchers believe Mary Polly Calloway was John's first wife, but no proof has been shown. One researcher notes a possible relationship because John's grandson was named Charles Calloway Ashley. Furthermore, Mary Polly Calloway's data is comingled with the records of John's possible second wife Mary Polly Hardin. Another theory could be that the two women are the same person: Mary Polly Hardin, needing to remarry for support after her husband's 1828 death, remarried a Mr. Calloway but no record for that was found and the question of who John's first wife was remains.

Some researchers, especially Hardin descendants, do not believe John Ashley's second wife was Mary "Polly" Hardin; they believe the preponderence of evidence points toward John Ashby marrying Polly Hardin in Mercer Co., KY in 1797, not John Ashley. The name at the bottom of the marriage bond apparently is Ashby, although elsewhere in the document it could easily be mistaken for Ashley. Polly's father was Nicholas Hardin. John Ashby and Nicholas Hardin were taxed in the same district in Mercer Co, KY in 1794, 1795 and in 1797 were taxed on the same date, indicating spatial proximity. John Ashby moved to Hopkins Co, KY by 1830 where he lived close to nine Ashby families and two houses away from Nicholas Hardin. Nicholas died and left a will naming his daughter Mary Ashby and appointing son-in-law John Ashby as an executor. Another possibility is there were two Mary "Polly" Hardins, each of whom married John Ashley and John Ashby about the same time; this researcher saw instances of this among members of the Schmidt family marrying in different states.

John is believed to be the John Ashley living in Mercer Co, KY, as shown on the Second Census of KY – Tax list 1800, and his possible marriage there to Polly Hardin. John and his wife Polly, ages over 45, were living in Adair Co, KY with six others in their family ranging in age from under 10 up to 25 in 1820. At some point John bought land in Pulaski County, KY (Pulaski and Adair are adjacent); he owned property on Pittman's Creek in Pulaski Co in 1820, which he sold in 1825, showing on the paperwork that he was living in Warren County, TN by that time.

John wrote his will on 11 Apr 1828: In the name of God Amen, I, John Ashley of the County of Warren and State of Tennessee being of perfect mind and memory ... first of all I give to my beloved Wife Polly Ashley the following property to wit: one cow and calf, two Beads and furniture, one flax and one Cotten Wheel, two head of sheep, one Sow and Seven piggs, also one years old Barrow, one kettle, one small pot and Skillet, and her Saddle, one Smothing Iron, one Chest, four peuter plates and four delph plates, one set of Tea Cups and Saucers, one Water, pale piggen [small wooden pail with handle] and milk Churn and Tin Bucket, also 2 Chaires, three knives and three Crocks, one Coffee pot and Soop Spoon, three Tin cups, one peuter dish and one delph dish, also one square table and one pot, Trammel and Washing tub, 2 Tumblers and two mugs.
